These terms and conditions, as may be amended from time to time, apply to all our services directly or indirectly (through distributors) made available online, through any mobile device, by email or by telephone. By accessing, browsing and using our website or any of our applications through whatever platform (hereafter collectively referred to as the “website”) and/or by completing a reservation, you acknowledge and agree to have read, understood and agreed to the terms and conditions set out below (including the privacy statement).

These pages, the content and infrastructure of these pages, and the online  reservations service provided on these pages and through the website (the “Siam Travel”) are owned, operated and provided by Go Siam Co., Ltd. (“Siam Travel “, “us”, “we” or “our”) and are provided for you subjected to the terms and conditions set out below.

 

Scope of our Service

Through the website, we (Siam Travel and our affiliate (distribution) partners) provide an online platform through which all types of temporary services providers, included Tourism Services (“Tours” and “Activities”) can advertise their services for reservation, and through which visitors to the website can make such reservations. By making a reservation through Siam Travel, you enter into a direct (legally binding) contractual relationship with the services provider at which you book. From the point at which you make your reservation, we act solely as an intermediary between you and the provider, transmitting the details of your reservation to the relevant services provider and sending you a confirmation email for and on behalf of the services provider.

When rendering reservation on Siam Travel, the information that we disclose is based on the information provided to us by services providers (Cruises, Tours, Activities). The service providers are fully responsible for providing us with the most recent rates, availability and other information which is displayed on our website. Although we will use reasonable skill and care in performing our services we will not verify if, and cannot guarantee that, all information is accurate and up-to-date.

Our services are made available for personal and non-commercial use only. Therefore, you are not allowed to re-sell, deep-link, use, copy, monitor (e.g. spider, scrape), display, download or reproduce any content or information, software, products or services available on our website for any commercial or competitive activity or purpose.

 

Prices and Best Price Guarantee

The prices on our site are highly competitive. All prices on the Siam Travel website are per person and are displayed including VAT tax and all other taxes (subject to change of such taxes), unless stated differently on our website or in the confirmation email.

Sometimes cheaper rates are available on our website for a specific tour or activity, however, these rates provided to us by our tour operators may carry special restrictions and conditions, for example in respect to cancellation and refund. Please check the tour details and additional information section thoroughly for any such conditions prior to making your reservation.

We want you to pay the lowest price possible for your stay, therefore, Siam Travel charges only the real retail price provided to us by tour operators we cooperate with. There is no additional fee or hidden charge applied to any service provided by Siam Travel. All displayed prices are definitive and will not change throughout the booking process, unless purchasing additional tour and activity addons that are completely optional.

The currency converter is for information purposes only and should not be relied upon as accurate and real time; actual rates may vary.

Obvious errors and mistakes (including misprints) are not binding.

All special offers and promotions are marked as such.

 

Privacy and Cookies

Siam Travel respects your privacy. Please take a look at our privacy and cookies policy for further information.

 

Free of Charge

Our service is free of charge because, unlike many other parties, we will not charge you for our service or add any additional (reservation) fees to the tour or activity rate.

 

Credit Card

For most service provided by Siam Travel, an option to pay with a Credit Card is available at the checkout. We do not charge any credit card processing fee, or any other fee connected with credit card payment other other than the price of purchased tour or activity visible at the checkout page.

 

Refunds

In rare situations, when a full or partial refund has to be given to Siam Travel customers after the payment has been made already, depending on the chosen method of payment (Credit Card, PayPal, Cash), a refund fee connected with transferring the money back to your account may be subtracted from the total purchase amount, which may be up to 4.5% of the total price paid.

There is no refund fee in case of cash payments whatsoever.

 

Hotel Pick-up and No-show Policy

Most of the tours and activities offered by Siam Travel include a free transfer from/to your hotel or apartment in Koh Samui area only. It is your responsibility to be present at the chosen pick-up point at the given time provided to you upon reservation. The pick-up time may vary depending on traffic situation on Koh Samui, and is subject to change without prior notice due to bad weather conditions.

In case of not being present at the chosen pick-up location at the given time, no refund will be given to the traveler for missing out on the tour, and full tour cost will be charged.

 

Cancellation

Tour and activity bookings made via Siam Travel website fall under the following cancellation policy:

  • Cancellations made not less than 4 days prior to the tour date:
    • Full refund is given to the traveler.
  • Cancellations made not less than 2 days and not more than 3 days prior to the tour date:
    • 50% refund of total purchase price is given to the traveler.
  • Cancellations made less than 2 days prior to the tour date:
    • No refund is given to the traveler.

Full refund will be given to travelers falling only under one of the following unexpected situations:

  • In case of sickness, injury or worsened health condition that is preventing the traveler to addend the purchased tour or activity. In such cases, a doctor statement clarifying the health condition of the traveler has to be provided to Siam Travel no later than on the date of the tour. The doctor statement can be either scanned and sent to [email protected] or delivered to our office by person.
  • In case of the tour operator cancelling the purchased tour or activity due to bad weather conditions preventing the operator from operating the tour safely, or any other technical difficulty forcing the tour operator to cancel the tour for the given date.

Siam Travel also reserves the right to withhold any deposit made before the booking as an administrative fee in case of cancellation only.

 

Weather Conditions

Under no circumstances is Siam Travel or the tour operator responsible for the weather conditions. The itinerary or tour itself may be changed, postponed, or even cancelled without previous notice resulting from bad weather conditions only. If such situation would occur, we will do our best to find you another appropriate date or offer you a refund based on our Refund and Cancellation policy.

In situations where bad weather conditions would affect the travel itinerary only, and not the entire tour or activity, no refund or cancellation may be offered to the traveler.

 

Tour Date Changes

In any other case other than “Cancellations made less than 2 days prior to the tour date”, the traveler may ask for a change of their tour date which is subject to availability. Siam Travel does not guarantee that a date change will be available at all times, and in some cases may not even offer this possibility for any of the booking made via Siam Travel website.

 

Last Minute & Late Bookings

Bookings made after 7 pm Thailand time (GMT +7 hours) have no guarantee of availability. In case a booking is made after 7 pm, and the chosen Tour or Activity is unavailable, the traveler may choose an alternative tour date that is still available.

 

Obligations and Responsibilities

Throughout the entire duration of the purchased tour or activity, the guest is responsible for taking care of their belongings, as Siam Travel will take no responsibility for loss or damage to any belonging of the traveler.

The traveler is also responsible for obeying the law of the Kingdom of Thailand, as well as any other rules set by the tour operator. If you fail to do so, you may be asked to leave or completely rejected from attending the purchased tour or activity without any right for refund.

There is strict no smoking policy on any vehicle or other mean of transportation owned by Siam Travel or the tour operator directly.

It is your own responsibility to follow the tour guide’s rules, and be present at at the given time and location through the entire duration of the tour or activity. Siam Travel or the tour operator takes no responsibility if a guest is left by due to not being present at the given time.

 

Disclaimer

Subject to the limitations set out in these terms and conditions and to the extent permitted by law, we shall only be liable for direct damages actually suffered, paid or incurred by you due to an attributable shortcoming of our obligations in respect to our services, up to an aggregate amount of the aggregate cost of your reservation as set out in the confirmation email (whether for one event or series of connected events).

However and to the extent permitted by law, neither we nor any of our officers, directors, employees, representatives, subsidiaries, affiliated companies, distributors, affiliate (distribution) partners, licensees, agents or others involved in creating, sponsoring, promoting, or otherwise making available the site and its contents shall be liable for (i) any punitive, special, indirect or consequential loss or damages, any loss of production, loss of profit, loss of revenue, loss of contract, loss of or damage to goodwill or reputation, loss of claim, (ii) any inaccuracy relating to the (descriptive) information (including rates, availability and ratings) of tours and activities as made available on our website, (iii) the services rendered or the products offered by the tour operators or other business partners, (iv) any (direct, indirect, consequential or punitive) damages, losses or costs suffered, incurred or paid by you, pursuant to, arising out of or in connection with the use, inability to use or delay of our website, or (v) any (personal) injury, death, property damage, or other (direct, indirect, special, consequential or punitive) damages, losses or costs suffered, incurred or paid by you, whether due to (legal) acts, errors, breaches, (gross) negligence, willful misconduct, omissions, non-performance, misrepresentations, tort or strict liability by or (wholly or partly) attributable to the tour, activity or any of our other business partners (including any of their employees, directors, officers, agents, representatives or affiliated companies) whose products or service are (directly or indirectly) made available, offered or promoted on or through our website, including any (partial) cancellation, overbooking, strike, force or any other event beyond our control.

 

Intellectual property rights

Unless stated otherwise, the software required for our services or available on or used by our website and the intellectual property rights (including the copyrights) of the contents and information of and material on our website are owned by Siam Travel, its suppliers or providers.

Siam Travel exclusively retains ownership of all rights, title and interest in and to (all intellectual property rights of) (the look and feel (including infrastructure) of) the website on which the service is made available (including the guest reviews and translated content) and you are not entitled to copy, scrape, (hyper-/deep)link to, publish, promote, market, integrate, utilize, combine or otherwise use the content (including any translations thereof and the guest reviews) or our brand without our express written permission. To the extent that you would (wholly or partly) use or combine our (translated) content (including guest reviews) or would otherwise own any intellectual property rights in the website or any (translated) content or guest reviews, you hereby assign, transfer and set over all such intellectual property rights to Siam Travel. Any unlawful use or any of the aforementioned actions or behavior will constitute a material infringement of our intellectual property rights (including copyright and database right).

 

Further Correspondence

By completing a booking, you agree to receive (i) an email which we may send you shortly prior to your tour date, giving you information on your purchased tour or activity and providing you with certain information and offers (including third party offers to the extent that you have actively opted in for this information) relevant to your reservation and tour, and (ii) an email which we may send to you promptly after your tour inviting you to complete our guest review form. Complaints

In the highly unlikely event, when you may wish to make a complain against tour, activity or other service purchased via Siam Travel website, please consider informing the tour operator throughout the duration of your travel at first. If the matter cannot be resolved with the tour operator directly on place, your complaint should be made in person at our office, or in writing emailed to [email protected] We will do our best to assist you in resolving your matter with the tour operator, 3-rd party provider or Siam Travel by its own. Siam Travel will not consider any complaints made after 30-days after the date of your travel.

 

Miscellaneous

Images and footage taken during any tour or activity by a Siam Travel representative may be used for promotional purposes on Siam Travel website, social media, or print materials (brochures, books, flyers) without further notice.

We take no responsibility for incorrect bookings or inability to deliver you a conformation mail due to an error caused by the traveler.

In some cases, a purchased tour or activity may be already fully book for the chosen date. If such situation occurs, we will do our best to find you another appropriate date that suits your program or offer you a similar tour in the similar price category with a different tour operator.

We reserve the right to change, remove, alter or completely delete any tour or activity offered by Siam Travel in case of the event being outside the control of Siam Travel.

We reserve the right to change prices of our offered services at anytime without further notice, or offer discount at anytime throughout the year.
